Prepayment and Foreclosure in India: What a Lender May and May Not Charge
For loans sanctioned from 1 January 2026, the RBI bars any prepayment charge on a floating-rate loan to an individual. Fixed-rate loans can still carry one, but only if it was in the Key Facts Statement. And prepaying early in the tenure is where the interest saving actually lives.

Short answer
Can a bank charge a prepayment penalty on a home loan in India?
Under the RBI (Pre-payment Charges on Loans) Directions, 2025, issued on 2 July 2025 and applying to loans sanctioned or renewed on or after 1 January 2026, no lender may charge a prepayment or foreclosure fee on a floating-rate loan taken by an individual for non-business purposes, with or without a co-borrower and regardless of where the money comes from. Floating-rate business loans to individuals and micro and small enterprises are also free of such charges at commercial banks, with some thresholds at smaller lenders. Earlier RBI circulars had already barred these charges on floating-rate loans to individuals, so older loans are largely covered too. Fixed-rate loans may carry a prepayment charge, but only if it was disclosed in the Key Facts Statement, never retrospectively, and never where the prepayment is at the lender's instance. Because interest is charged on a reducing balance, prepaying in the early years of a long loan saves far more than the same amount prepaid later, which is what the home loan prepayment calculator shows.
Our practical verdict
The question of whether a lender can charge you for repaying it early was settled for most Indian borrowers by the Reserve Bank's directions of 2 July 2025. For loans sanctioned or renewed from 1 January 2026, no lender may charge a prepayment or foreclosure fee on a floating-rate loan to an individual for non-business purposes. It does not matter whether there is a co-borrower, whether the repayment is partial or complete, or whether the money is your own or another lender's. Floating-rate business loans to individuals and small enterprises are largely covered too, with exceptions at the smallest lenders. And because the RBI had already barred such charges on floating-rate loans to individuals in 2014 and 2019, most older floating loans were free to prepay before the new directions arrived.
Fixed-rate loans are the exception, and a bounded one. A lender may charge to prepay a fixed-rate loan, but only if the charge was stated in the Key Facts Statement at sanction, never added later, and never where the lender itself initiated the prepayment. A charge you were not shown is not a charge you owe.
With the fee question answered, the useful question is when. Interest on a reducing-balance loan is front-loaded: in the early years most of each EMI is interest and little is principal, and the proportion reverses towards the end. A Rs 2 lakh prepayment in the second year of a twenty-year home loan removes a large amount of future interest; the same Rs 2 lakh in the twelfth year removes much less, because most of the interest has already been paid. When you prepay, choose to shorten the tenure rather than lower the EMI if paying less interest is the aim. The home loan prepayment calculator shows both.

Pick 1
Floating rate, individual, non-business: no charge
For loans sanctioned or renewed from 1 January 2026, the 2025 directions prohibit any prepayment or foreclosure charge on a floating-rate loan to an individual for non-business purposes. It does not matter whether there is a co-borrower, whether you prepay in part or in full, or whether the funds come from savings or from another lender refinancing you. A home loan, a car loan or a personal loan on a floating rate falls here.
Pick 2
Floating rate, business purposes: mostly no charge
Floating-rate loans to individuals and micro and small enterprises for business purposes are also free of prepayment charges at commercial banks, with exceptions for small finance banks, regional rural banks and local area banks, and sanctioned-amount thresholds at some other lenders. If the loan is for a business, check which category the lender falls in.
Pick 3
Older loans
The RBI's circulars of 2014 and 2019 already barred prepayment charges on floating-rate loans to individuals, so a floating home loan taken years ago is very likely already free to prepay. The 2025 directions consolidate and extend that position rather than creating it. If a lender quotes a charge on an old floating loan, ask it to cite the rule.
Pick 4
Fixed rate: allowed, but only if disclosed
A fixed-rate loan may carry a prepayment charge. The directions require it to be stated in the Key Facts Statement up front, bar any retrospective levy, and bar a charge where the prepayment happens at the lender's instance. A fixed-rate charge you were not shown at sanction is not one you owe. The sanction letter guide covers where to find the line.
Pick 5
Where the saving actually is
Interest on a reducing-balance loan is front-loaded: early EMIs are mostly interest, late ones mostly principal. A Rs 2 lakh prepayment in year two of a twenty-year home loan removes far more interest than the same Rs 2 lakh in year twelve. Run the figures in the home loan prepayment calculator before deciding when, and choose to shorten the tenure rather than reduce the EMI if the aim is to pay less interest.
Pick 6
Prepay or invest
With no charge on a floating loan, the only question is whether the money does more work reducing the loan or invested elsewhere. That depends on the loan rate against a realistic post-tax return and on how you value the certainty. The prepay or invest comparison sets the two side by side; the honest answer is different for a loan at 8.5 percent and one at 11.
Pick 7
Balance transfer is a prepayment
Refinancing with another lender means the new lender prepays the old one, and on a floating-rate loan to an individual that transfer now carries no exit charge. What it does carry is the new lender's processing fee and any state charges on a fresh mortgage, so a transfer for a small rate difference can cost more than it saves. Compare the total, not the rate.

Whether to prepay at all is then a comparison, not a rule. Money that reduces a loan at 8.5 percent earns a guaranteed 8.5; money invested instead earns whatever it earns, after tax, with whatever certainty that carries. For a loan at 11 percent the answer leans one way; for one at 8 with a long horizon it may lean the other. The prepay or invest comparison sets the two side by side.
One more thing follows from the no-charge rule. Moving a floating loan to another lender is a prepayment by the new lender, and it now carries no exit fee. It does carry the new lender's processing fee and, on a home loan, fresh mortgage registration in the state, which can run to tens of thousands of rupees. A transfer for a quarter-point difference can cost more than it saves. Compare the total cost of moving against the total interest saved over the remaining tenure, and read the new lender's Key Facts Statement with the same care as the first.

FAQ
Can a bank charge a prepayment penalty on a home loan in India?
Not on a floating-rate home loan to an individual. The RBI's 2025 directions bar any prepayment or foreclosure charge on such loans sanctioned from 1 January 2026, and earlier circulars already barred it. A fixed-rate loan may carry a charge only if it was disclosed in the Key Facts Statement.
When is the best time to prepay a loan?
As early in the tenure as possible. Interest on a reducing balance is front-loaded, so a prepayment in the early years removes far more interest than the same amount later. Shortening the tenure saves more than reducing the EMI.
Is there a charge for transferring my home loan to another bank?
No exit charge on a floating-rate loan to an individual. The new lender's processing fee and any fresh mortgage registration charges apply, so compare the total cost against the rate saving.
Should I prepay my loan or invest the money?
It depends on the loan rate against a realistic post-tax return and how much you value certainty. With no prepayment charge on floating loans, that comparison is the whole decision.
